Our recent experience in antitrust and competition law includes acting for the following:
- a new entrant into the retail energy supply market where the client was almost entirely dependent on a price comparison website for access to customers. We prepared a complaint to the UK competition regulator regarding the terms on which the client’s offering was visible to consumers on the price comparison website. We achieved a commercial settlement securing the client’s visibility and flow of business
- a well-known American web hosting service provider on resale price maintenance issues and the structure of its relationships with third parties where the client’s products and services were provided on a turnkey solution or a white label basis. This included advising the client on a UK competition investigation into the terms for consumers and successfully achieving closure of the investigation
- a global household products manufacturer in the European Commission’s detergents cartel investigation. We attended the dawn raid at the global headquarters and coordinated the defense of raids in seven other jurisdictions. We defended our client in the subsequent two year investigation, after which no charges were filed against our client even though its major rivals were fined over €300 million
- a household appliances company in connection with the EU Commission sector inquiry into the internet of things, a high profile inquiry that will be used to inform the EU Commission’s approach to competition policy in the digital economy
- a global insurance firm in an investigation of the aviation insurance market before the European Commission, as well as coordinating derivative investigations in Brazil and in Singapore;
- an agricultural producer in a nationwide antitrust class action and related opt-out litigation involving allegations of price fixing and supply restrictions
- a Fortune 500 company in dozens of antitrust actions, consolidated in a multidistrict litigation (MDL), alleging an alleged a conspiracy among insurance companies to set rates
- a NASDAQ-traded healthcare company in defense of aFederal Trade Commission (FTC) investigation and subsequent grand jury investigation of alleged antitrust violations
