Rocco Testani is a partner in the litigation practice group and also serves as the firm’s General Counsel.
He most recently served as the co-head of Global Litigation and is former member of the firm’s Executive Committee. Over the past 30+ years, Rocco has tried numerous cases in both federal and state courts and in arbitral forums. He has a broad range of experience, including successfully litigating and trying “bet the company” business disputes and representing governors, state legislatures and other officials in high-profile public policy and constitutional law cases. Rocco has also served as outside general counsel to two large public school districts and as a special assistant attorney general.
Clients benefit from Rocco’s extensive subject matter experience, practical counsel, and responsiveness. He collaborates with in-house lawyers, political leaders and their counsel, and other high-level business executives, becoming part of their team to understand their objectives. Those objectives may require that a case be tried, and being prepared to do so. In other circumstances, positioning the case to achieve a favorable settlement best serves the client’s objectives. Rocco has the experience and judgment to evaluate the strengths and challenges of the case in order to implement the most appropriate strategy.
Outside of his firm work, Rocco spends a good deal of his professional time working on civil justice reform in the state of Georgia. He was a leader in the establishment of the state-wide Business Court (modeled after the Delaware Court of Chancery) and chairs the amicus curiae committee of Georgians for Lawsuit Reform, which advocates for business interests in the state’s appellate courts. Rocco is also a frequent presenter on public education legal issues and is a member of the advisory committee of the Harvard University Program on Educational Policy and Governance. Rocco also serves on numerous non-profit boards in the Atlanta community.

- Lead trial counsel for a national parking management company in defense of claims for breach of term sheet brought by a major private equity firm in which the plaintiff sought millions of dollars in lost profit damages. After a four-week jury trial in federal court, the jury found in favor of our client. Verdict and judgment affirmed by the First Circuit.
- Lead trial counsel for the State of Florida in a constitutional challenge to the state’s $19 billion public school funding system. Prevailed after a month-long trial and on appeal to the Florida Supreme Court.
- Lead counsel for a Big Three automobile manufacturer in litigation brought by New York City-area dealers seeking millions of dollars in warranty parts reimbursement under franchise agreements and state law. Obtained summary judgment for the client.
- Lead counsel for a special committee of the board of directors of a major media company in class action and shareholder derivative proceedings seeking to enjoin a proposed $1 billion management-led buyout. Obtained dismissal of all claims in multiple forums.
- Represented a private equity firm in connection with multiple claims arising from a series of corporate acquisitions and facilitated substantial recovery under representations and warranties insurance.
