Sam Andrews is a Principal Associate for our Litigation & Arbitration group.
Sam’s recent experience includes disputes concerning cryptoassets, foreign exchange finance agreements, FCA regulated products and group litigation orders. He has particular expertise in cross-border and multi-jurisdictional disputes.
Sam has acted for a number of major financial institutions in relation to retail litigation, including a broad range of unfair relationship and consumer credit/finance claims.
Sam has undertaken a secondment with the Financial Services Compensation Scheme's legal team, advising on a variety of defaults, including those concerning SIPP operators.
Sam was also part of the team acting in Russell Adams -v- Options UK Personal Pensions LLP (acting for Options), in which the Court of Appeal provided the leading judgment on the extent of duties owed by an execution only SIPP administrator, the application of COBS to SIPP administrators and the application of s.27 FSMA, which was previously untested by the courts.
Sam's recent experience includes:
- acting on behalf of a global foreign exchange finance provider in the recovery of contractual sums across multiple jurisdictions
- acting for a SIPP (pensions) operator in relation to claims and complaints arising from their acceptance of business from unregulated introducers, including playing a key role in the team representing the client in the Court of Appeal
- advising retail banking clients on a broad variety of claims relating to consumer credit, unfair relationships and satisfactory quality disputes
- working with various retail banking client service teams to implement innovative solutions to document automation and process efficiencies in relation to a number of litigation portfolios
- advising a retail banking client on the application of the Quincecare duty and attending a successful pre-action mediation to resolve a threatened claim
