Michael advises clients on all aspects of labor and employment issues, which includes litigation and day-to-day advice.
Michael has a wealth of experience in working with human resource professionals, in-house counsel and other non-lawyers to provide practical, actionable advice. He articulates what the law means for them and addresses their issues efficiently and effectively. Michael is experienced in a wide variety of labor and employment matters, and at working closely with other firm resources such as our tax lawyers to provide clients with counsel that is both clear and concise but lends itself to complex concerns.
Michael represents employers and a broad range of companies and organizations in various business disputes, including:
- Trade secret cases
- Non-compete issues
- Discrimination
- Harassment and retaliation
- Wage and hour concerns
- Fair Labor Standards Act (FLSA)
- Family and Medical Leave Act (FMLA)
- Worker Adjustment and Retraining Notification Act (WARN)
- Breach of contract claims
- Other federal and state statutes
Michael also represents employers in cases pending before the Equal Employment Opportunity Commission (EEOC) and state employment agencies (including the Texas Workforce Commission), and in Department of Labor investigations.
Michael’s experience also includes traditional labor matters. He has assisted clients with grievance disputes and arbitration; National Labor Relations Board charges; union elections; and bargaining efforts. He is adept at working with HR representatives and with senior-level company officials on high-level corporate problems, assisting clients with worker interest in forming a union, union campaigns and elections and leadership transitions.
Additionally, Michael assists clients with day-to-day issues that arise, including employee accommodation requests, investigations and employee agreements. He can easily address how best to protect client information from employees who may take company data to their new employer, or explain the process of a forensic investigation that may include a review of printing, cloud storage, emails and thumb drives. Partnering with clients and preparing them in advance for possibilities is where Michael excels.

- Won summary judgment in favor of a technology client in arbitration in connection with an employee discrimination matter, which resulted in dismissal of the case.
- Guided and assisted a milling company in successfully withdrawing recognition of a union at one of its worksites and prevailed against an unfair labor charge filed by the union during withdrawal.
- Won partial summary judgment in favor of a media and entertainment company in an age discrimination and Family and Medical Leave Act (FMLA) matter.
- Won summary judgment in favor of a manufacturing client in a race discrimination matter, which resulted in dismissal of the case.
