Our Higher Education practice focuses on administrative, transactional, regulatory, and litigation matters affecting colleges and universities, including with respect to collegiate athletics. We can help you with a variety of compliance matters before the US Department of Education, accreditors, and state licensing bodies, including complex transactions affecting institutional ownership and control. We can also provide you with guidance on compliance matters and strategic issues pertaining to their participation in the federal student financial assistance programs, accreditation, state authorization, and related questions.
Additionally, our team guides institutions through the changing state of play in college athletics, including prospective revenue sharing, name, image and likeness arrangements, and NCAA and related rules compliance.
Our attorneys possess a depth of experience on a wide array of litigation, compliance, regulatory, and governmental issues affecting all sectors of secondary and postsecondary education. Representative experience includes:
- serving as lead counsel to the Florida Senate, House of Representatives and State Board of Education in a constitutional challenge to Florida’s US $19 billion K-12 public school funding system
- representing the states of New York, Delaware, Minnesota, Missouri, North Dakota, Georgia and Michigan in constitutional funding litigation
- serving as outside general counsel to the DeKalb County School District and the Fulton County School District which are among the largest fifty school districts in the US
- representing all charter schools in the Atlanta Public School System (APS) in litigation against APS, seeking recovery of millions of dollars in local revenue funding under state law
- advising public and private universities in regard to U.S. Department of Education certification matters, federal student aid compliance, accreditation, and state licensure
- advising multiple institutions and investor groups in regard to transactions and substantive changes that implicate federal, state, and accreditor approval requirements pertaining to changes in ownership and control
- representing colleges and universities on compliance matters pertaining to student lending, the negotiated rulemaking process, institutional and student funding pursuant to the CARES Act, and other federal, state, and accreditation requirements
